Landowners’ Rights Validated By State High Court – Pipeline surveys without landowners’ permission violate basic rights, state high court agrees
As pipeline surveyors begin work to assemble rights of way for three major pipeline projects in West Virginia, property owners should remember an important ruling handed down by the West Virginia Supreme Court last November that found developers of the Mountain Valley Pipeline can’t survey land for the project without the landowner’s permission.
Justice Robin Davis found there was no proof that MVP would serve a “public use” — a requirement for developers to force landowners to allow such surveys.
Pipeline lobbyists tried unsuccessfully to change the state law containing the requirement last year.
