Michael Murphy Appointed to Plaintiffs’ Steering Committee in Blue Cross Blue Shield Antitrust MDL

Michael Murphy, a partner in the firm’s Washington D.C. office, was appointed to the plaintiffs’ steering committee for provider track discovery in pending multidistrict litigation case, In re: Blue Cross Blue Shield Antitrust Litigation (MDL No. 2406).

The lawsuit, filed by employers and providers, claims that members of the Blue Cross Blue Shield Association agreed not to operate outside of designated ‘service areas,’ ensuring that they will not compete with each other. This agreement amounts to unlawful horizontal market allocation, which reduces the competition that each Blue faces and allows it to reduce the prices that it pays to healthcare providers.

In June 2014, Judge R. David Proctor of the United States District Court for the Northern District of Alabama denied several motions to dismiss claims against Blue Cross Blue Shield Association and all of its members for violating federal antitrust law.
